K+S Services surplus is guaranteed to be in working condition and is warranted for one full year. All warranties are issued by K+S Services, Inc. and not the manufacturer and will be honored by K+S Services, Inc. If the unit is found defective within one year of the invoice date, return it for a free replacement or repair. (If you need to make a warranty return claim please contact us at surplus@k-and-s.com. All Surplus products sold by K+S Services, Inc. are warranted to our customer only and as follows: such products shall be free from material defect (under normal use, storage, handling, installation and other normal conditions) for a period of 12 months from the date of sale. Our obligation shall be limited to the repair or replacement, at our choice, of any such defective product (or part thereof as we determine) free of charge to our customer; if we decide that the product cannot be repaired or replaced, we shall credit your account in an amount equal to the sum you paid us for it. Any warranty claim must be received before the end of the 12 month warranty period, together with return of the claimed defective product within this same period. This warranty is given in lieu of any other warranties, either express or implied, including that we disclaim any warranty of merchantability, fitness for a particular purpose and/or non-infringement. In no event shall we be liable for any damages except actual damages up to, but not exceeding, the amount paid to us for the product, including we shall not be liable for any consequential or indirect damages or lost profits whether or not advised of same. K+S Services, Inc. is not a distributor sanctioned by the original manufacturer and we are not a party to any manufacturer’s warranty that may or may not apply.

If you are dissatisfied with a product from K+S Services you may return the product within 30 calendar days of the invoice date. A 25% restock administration fee will apply to all non-warranty returns. No non-warranty returns will be accepted 30 days after the invoice date. Surplus product may be weathered, or discolored. We do not accept returns of surplus based on the date manufactured or the cosmetic condition of product or packaging. All 'Used Surplus. Surplus may not come with manual(s) or other accessories normally supplied when buying factory new. Refunds will be issued only upon receipt and testing. Product must be returned in purchased condition.

The content is provided without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or noninfringement. K+S Services and its licensors do not warrant that all information is accurate, reliable or correct; that this site will be available at any particular time or location; or that the content is free of viruses or other harmful components. Your use of this site is solely at your risk. Because some jurisdictions do not permit the exclusion of certain warranties, these exclusions may not apply to you.

Upon a request by K+S Services, you agree to defend, indemnify, and hold harmless K+S Services or other affiliated companies, and their employees, contractors, officers, and directors from all liabilities, claims, and expenses, including attorney's fees, that arise from your use or misuse of this site. K+S Services reserves the right, at it's own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with K+S Services in asserting any available defenses.

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Michigan, (without regard to conflict of law principles). You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms of Use or your use of this site shall be filed only in the state or federal courts located in the State of Michigan, and you further expressly agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.

K+S Services and its affiliates, licensors, distributors or supplier are not liable for any indirect, special, incidental, or consequential damages (including damages for loss of business, loss of profits, litigation, or the like), whether based on breach of contract, breach of warranty, tort (including negligence), product liability or otherwise even if advised of the possibility of such damages,arising out of or relating to use of this site. The limitations of damages set forth above are fundamental elements of the basis of the bargain between K+S Services and the customer. The goods and services provided from this site would not be provided without such limitations. Some state statutes may apply regarding limitations of liability.

The sole and entire maximum liability of K+S Services and any of the providers of products or services, for any reason, and the customer's sole and exclusive remedy for any cause whatsoever, shall be limited to the amount paid by the customer for the product or service purchased.

For all transactions, the customer represents and warrants that (i) the credit card information supplied is true, correct and complete, (ii) charges incurred by the customer will be honored by the customer's credit card company, and (iii) the user shall pay charges incurred by the customer at the rates in effect at the time incurred, including all applicable taxes. The customer shall indemnify, defend and hold K+S Services, Inc and its personnel harmless against any claims against some or all of them in relation hereto. The customer shall be responsible for all charges incurred through use of the customer's password. The customer agrees to keep his or her password confidential and to notify K+S Services within 24 hours of any breach of this Agreement or unauthorized use of the password. K+S Services does not protect the customer from unauthorized use of the customer's password.

Orders that are shipped to countries outside of the U.S. may be subject to import taxes, customs duties and fees levied by the destination country. These charges for customs clearance must be paid by the recipient; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country. Please contact your local customs office for information. When customs clearance payment and/or procedures are required it can cause delays beyond our delivery estimates. Credit Card verification may take up to 72 hours. Wire Transfers: Allow 3 - 5 business days for receipt of funds.

Unless otherwise specified herein, this agreement constitutes the entire agreement between you and K+S Services with respect to this site and supersedes all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and K+S Services with respect to this site. If any part of these Terms of Use is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

K+S Services reserves the right, in its sole discretion, to terminate your access to all or part of this site, with or without notice.
